§ 1 Information on the collection of personal data
(1) In the following, we provide information regarding the collection of personal data when you use our website. Personal data refers to any data that can be personally identified to you, such as your name, address, email addresses, and user behavior.
(2) The controller pursuant to Article 4(7) of the EU General Data Protection Regulation (GDPR) is mpunkt GmbH, Schießgrabenstraße 6, 86150 Augsburg, info@mpunkt.com (see our legal notice). You can contact our Data Protection Officer at datenschutzbeauftragter@mpunkt.com or at our postal address with the addition “Data Protection Officer.”
(3) When you contact us via email or through a contact form, we will store the data you provide (your email address, and, if applicable, your name and phone number) in order to answer your questions. We will delete the data collected in this context once storage is no longer necessary, or restrict processing if statutory retention obligations apply.
(4) If we use contracted service providers for individual functions of our service or wish to use your data for advertising purposes, we will inform you in detail below about the respective processes. In doing so, we will also specify the established criteria for the storage period.
§ 2 Your rights
(1) You have the following rights with respect to the personal data we hold about you:
- Right of access,
- Right to rectification or erasure,
- Right to restriction of processing,
- Right to object to processing,
- Right to data portability.
(2) You also have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data.
§ 3 Collection of personal data when visiting our website
(1) When you use the website for informational purposes only—that is, if you do not register or otherwise provide us with information—we collect only the personal data that your browser transmits to our server. When you view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (the legal basis is Art. 6(1)(f) of the GDPR):
- IP address
- Date and time of the request
- Time zone difference from Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Access status/HTTP status code
- Amount of data transferred in each case
- Website from which the request originates
- Browser
- Operating system and its user interface
- Language and version of the browser software.
(2) In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and associated with the browser you are using, and through which certain information is transmitted to the entity that sets the cookie (in this case, us). Cookies cannot execute programs or transmit viruses to your computer. They serve to make the website more user-friendly and effective overall.
(3) Use of cookies:
a) This website uses the following types of cookies, the scope and functionality of which are explained below:
- Transient Cookies (see b)
- Persistent Cookies (see c).
b) Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. These store a so-called session ID, which allows various requests from your browser to be associated with the same session. This allows your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close your browser.
c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete the cookies in your browser’s security settings at any time.
d) You can configure your browser settings according to your preferences and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all features of this website.
e) If you have consented to the use of cookies via our cookie banner, we will place a persistent cookie on your device to store this consent. This means you will not need to provide your consent again the next time you visit our website. This cookie is deleted after 365 days.
§ 4 Web Analytics / Google Analytics
(1) This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies,” text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie regarding your use of this website is generally transmitted to a Google server in the United States and stored there. However, if IP anonymization is enabled on this website, your IP address will be truncated by Google beforehand within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator.
(2) The IP address transmitted by your browser as part of Google Analytics is not combined with other data held by Google.
(3) You can prevent the storage of cookies by adjusting your browser software settings accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.
(4) This website uses Google Analytics with the “_anonymizeIp()” extension. This ensures that IP addresses are processed in a truncated form, thereby preventing any personal identification. To the extent that the data collected about you is personally identifiable, this is immediately excluded and the personally identifiable data is thus promptly deleted.
(5) We use Google Analytics to analyze the use of our website and to improve it on a regular basis. The statistics obtained allow us to improve our offering and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the U.S., Google has submitted to the EU-U.S. Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Art. 6(1)(f) of the GDPR.

§ 5 Integration of Google Maps
(1) We use Google Maps on this website. This allows us to display interactive maps directly on the website and enables you to use the map feature conveniently.
(2) When you visit the website, Google receives information indicating that you have accessed the relevant page of our website. In addition, the data listed in Section 3 of this statement is transmitted. This occurs regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data is directly associated with your account. If you do not wish for this data to be associated with your Google profile, you must log out before activating the button. Google stores your data as usage profiles and uses them for advertising, market research, and/or to tailor its website to your needs. Such analysis is carried out in particular (even for users who are not logged in) to provide targeted advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, in which case you must contact Google to exercise this right.

§ 6 Newsletter
(1) With your consent, you can subscribe to our newsletter, through which we will keep you informed about our latest interesting offers.
(2) We use the so-called double opt-in procedure for subscribing to our newsletter. This means that after you subscribe, we will send an email to the email address you provided, asking you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of this procedure is to verify your registration and, if necessary, to investigate any potential misuse of your personal data.
(3) The only information required to receive the newsletter is your email address. Once you have confirmed your subscription, we will store your email address for the purpose of sending you the newsletter. The legal basis for this is Article 6(1)(a) of the GDPR.
(4) You may revoke your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can revoke your consent by clicking the link provided in every newsletter email, by sending an email to info@mpunkt.de, or by sending a message to the contact details listed in the legal notice.
(5) Please note that we analyze your user behavior when sending the newsletter. For this analysis, the emails we send contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. For the analysis, we link the data mentioned in § 3 and the web beacons to your email address and a unique ID.
Links received in the newsletter also contain this ID.
The data is collected exclusively in pseudonymized form; the IDs are therefore not linked to your other personal data, and direct personal identification is ruled out.
You can opt out of this tracking at any time by clicking the dedicated link provided in each email or by contacting us through another channel. The information is stored for as long as you remain subscribed to the newsletter. After you unsubscribe, we store the data for purely statistical and anonymous purposes. Such tracking is also not possible if you have disabled the display of images by default in your email program. In this case, the newsletter will not be displayed in full, and you may not be able to use all features. If you manually enable the display of images, the tracking described above will take place.
